Contractual, commercial and compliance advice

Advised a major Australian electricity utility in relation to the compulsory acquisition of land, contractual rights and interests, contract works variation claims and compliance with the National Electricity Rules.

Oil and Gas Disputes

Acted as counsel for major international oil and gas companies in confidential arbitrations concerning a range of issues, including petrochemical pricing, remediation, challenging new regulations and major construction projects.

Security of Critical Infrastructure Advice

Advised a major Australian critical infrastructure owner and operator on various projects in relation to legal, operational and technical compliance with the Security of Critical Infrastructure Act 2018 (Cth) and associated industry regulations.

Investment Treaty Protection Advice

Advised major Australian resource companies on restructuring for investment treaty protection in Africa, Asia and South America. 

Regulatory Dispute

Assisted a major energy industry participant to respond to requests for information and evidence in relation to Federal Court proceedings commenced by the Australian Energy Regulator against wind farm operators for alleged breaches of the National Electricity Rules during a widespread blackout in 2016. 

Contract Dispute

Representing the Singapore subsidiary of a NYSE-listed international coal company in a dispute arising out of a series of contracts with a coal mining company (ICC arbitration, Singapore). 

Contract Dispute

Representing consulting company in recovery proceedings against state and local governments in relation to its entitlement to payment pursuant to its engagement to assist in negotiations with South Australia’s electricity distribution network provider.

Pricing Dispute

Represented a European manufacturer of solar panels in a US$60 million dispute brought by a Korean company, arising from substantial swings in the price of the commodity which was the subject of a contract between them. Worked with Korean counsel to formulate a defence based on the civil law concept of ‘collapse of the transaction’ (ICC arbitration, Hong Kong). 

Mining Works Contracts

Advised various mining entities on contractual risks, the negotiation of departures and the resolution of disputes in relation to works contracts at mine sites located in Western Australia, the Northern Territory, South Australia, New South Wales and Queensland.

Energy and Petroleum Dispute

Representing two United Arab Emirates entities in relation to a US$50 million dispute with a major Chinese oil and gas company for failing to pay invoices for products delivered.
