New Royal Adelaide Hospital

Representing the South Australian Government in multi-party litigation in the Supreme Court of South Australia and the Federal Court of Australia and arbitrations (ACICA) arising out of the AU$2.5 billion PPP arrangements for the design, construction and operation of the state’s preeminent health facility. 

Modern Food Company

Representing defendant franchisees in a £30 million dispute in London’s High Court concerning the alleged breach of franchise agreements in Saudi Arabia, IP infringement and conspiracy to cause damage. See case study below. 

Lumibird Group

Represented the listed multi-national medical, defence and industrial technology group in defending proceedings brought in the Supreme Court of South Australia by an ASX-listed competitor. The proceedings involved contested allegations of breached duty of confidence and misleading and deceptive conduct in contravention of the Australian Consumer Law

Cargill v Viterra

Represented the multinational agribusiness group in appeal proceedings in the Court of Appeal of the Supreme Court of Victoria concerning a trial judgment of AU$293 million arising from alleged misleading and deceptive conduct in the sale of a subsidiary.

Banco Santander Totta

Represented four Portuguese transport companies in defending and settling claims by the bank which sought to enforce arrangements concerning derivative transactions that would have otherwise resulted in our clients paying interest rates of up to 92.5%.

Commercial property fraud

Represented a group of investors in a claim to recover over AU$20 million invested in commercial property. The proceedings involved freezing and restraining orders, and successful applications for the appointment of receivers to take possession of and sell commercial property worth more than AU$10 million.

CleanFin

Representing a company in a derivate action in proceedings in the Federal Court of Australia involving breaches of trust and fiduciary duties by the company’s former directors and seeking an account of profits from the former-director’s alter-ego company as a knowing recipient.

Recovery proceedings

Representing a consulting company in recovery proceedings against state and local governments in relation to its entitlement to payment pursuant to its engagement to assist in negotiations relating to energy supply agreements.

Multi-party breach of contract, negligence and misleading and deceptive conduct claim

Representing international wine company in multi-party claim relating to the destruction of goods that were in the custody and control of a provider of storage and warehousing services, including matters of insurance.
