Courtney Chow

Expertise and Practice

Courtney is experienced in commercial dispute resolution, representing companies and small enterprises in the construction, professional services, government, medical and energy sectors. Her projects have included large corporate collapses involving breaches of directors’ duties, professional negligence and insolvent trading, construction defaults, delays and disruption, and breach of contract.

Courtney quickly impresses all with her attention to detail, work ethic and positivity. She is a dedicated and intelligent practitioner who invites the trust and respect of everyone she works with. Courtney is also the Treasurer of the Women Lawyers’ Association of South Australia.

Courtney commenced at LK in 2017. She has a Bachelor of Laws (First Class Honours) and Bachelor of Commerce (Accounting) from the University of Adelaide. She completed Associateships with the Honourable Chief Justice Kourakis of the Supreme Court of South Australia and Judge Beazley of the District Court of South Australia. Courtney is admitted to the Supreme Court of South Australia, the Federal Court of Australia and the High Court of Australia. She is proficient in written and spoken Chinese (Mandarin and Cantonese).

Experience

new Royal Adelaide Hospital

Representing the South Australian State Government on various strategic and legal issues concerning major defaults, delays and disruption in arbitral and Federal Court proceedings arising out of the AU$2.5 billion public-private partnership arrangements for the design, construction and operation of the State’s major health facility.

Confidential Professional Negligence Claim

Working with an offshore firm to defend another professional services firm in relation to allegations of professional negligence.

Western Desert Resources Liquidation

Represented the liquidators of Western Desert Resources, an iron ore mining operation in the Northern Territory that collapsed with creditors in the order of AU$200 million and subsequent liquidator’s avoidance actions including preference claims exceeding AU$100 million.

Parliamentary Select Committee Inquiry

Supporting counsel assisting a Select Committee of the South Australian Parliament. The inquiry concerned a decision by the then Attorney-General and Deputy Premier to refuse development approval for a new deep-water port on Kangaroo Island and related issues of conflict of interest.

Enerven Infrastructure v Cocchiaro & Ors

Representing the applicants in multi-party Federal Court (South Australia) proceedings seeking urgent injunctive relief and search orders to recover confidential information allegedly misappropriated by former employees, and pursuing claims for breach of equitable, statutory and contractual obligations.

Risk Management Advice

Advising major Australian electricity utilities on a range of risk matters, including uplifts in governance and risk management.

Employment Proceedings

Represented an employer in proceedings brought by a former employee in the Fair Work Commission and South Australian Employment Tribunal alleging unfair dismissal and other breaches of the Fair Work Act 2009 (Cth).

Costs Proceedings

Represented the former liquidator of a group of companies in costs proceedings arising out of a successful appeal in the Supreme Court of South Australia against allegations of negligence and related breach of duties.
